Terms and conditions

1. AREA OF APPLICATION

Our general business conditions, with which our customers agree on the issue of an order, shall apply exclusively. We do not accept dissenting conditions on the part of the customer of third parties, unless we have expressly accepted their validity. All offers in this webshop are directed at the consumer (every natural person finalising the contract in a manner which cannot be assigned to his or her commercial or self-employed occupational activity, §13 BGB). By placing an order you warrant that you are at least 18 years old (or have parents‘ permission to buy from us) and accept these terms and conditions.

2. CONCLUSION OF CONTRACT

There are four steps in the ordering process. By clicking on the button "Add to cart", the desired product can be put into the shopping basket, this action does not mean you have any commitment to the product. The shopping basket can be reviewed at any time by clicking on the "Your Cart" link, any product previously put into the shopping basket can be removed at any time. If you wish to purchase the items contained in your shopping cart, click on the "Go to Checkout" button, enter your email-adress and select your desired payment method. Click on the "Next Step" Button to reach the order section "Shipping Details", then enter the required information. Before confirming the order, the customer has the possibility to check and change the order and personal data and can cancel the order if necessary. By clicking the button "Complete Purchase" in the final step of the ordering process, you make a binding purchase offer concerning the products contained in the shopping cart, and agreeing to our terms and conditions. After placing the order, the customer will receive an automated order confirmation by email. This does not represent an acceptance of the customers order, but represents a confirmation that the order has reached us. The product is officially sold when we confirm the contract via email. In the rare event that the delivery to the buyer is not possible, or if delivery is delayed, the customer will immediately be informed by email. Please be aware that the screen display may differ from the original colours.

4. CONTRACT STORAGE

We will save the contract agreement after the contract has been finalized. It is possible to print the order and the given details in the course of the ordering process. Any data relating to orders and the terms and conditions will be sent with the confirmation email to the email adress given in the ordering process.

5. RESERVATION OF PROPERTY RIGHTS

Products remain our property until payment has taken place.

6. PRICES, SHIPPING COSTS AND RETURN COSTS

All prices are retail prices excluding value added tax (small entrepreneurs to Section § 19 UStG). Please note that local charges (customs duty, sales tax) can occur, depending on your region and local customs duties. These charges are at your own expense. All prices do not include shipping costs. Shipping and handling charges for deliveries within Germany are 6,00 € per shipment. For countries outside Germany but within Europe, shipping and handling charges are 15,00 €. Shipping costs for non-EU countries are 35,00 €. The customer is responsible for all the directs costs of returning the goods.

7. SHIPPING AND DELIVERY CONDITIONS

Delivery takes place within the delivery deadline given on the relevant page in regards to the address to which the product is to be delivered. We cannot ship to postbox addresses. Our products are delivered by UPS. Regarding prepayment the deadline given for delivery begins the day the full price is paid. The items will be forwarded to the delivering parcel service (UPS) within 7-21 working days after receiving the payment. The shipping time is 1-2 working days within Germany and 2-6 working days to most European countries. For further information or details check www.ups.com. If the shipment cannot be delivered due to the specification of an incorrect or incomplete shipping address by the customer, shipping will only be carried out again when the customer pays the additional charges for a second shipping. They must be paid in advance before the second shipping takes place. Upon receival of the goods, the customer is obliged to examine the package immediately for any transport damages and to inform us instantly in writing to enable us to assert any claims.

8. PAYMENT

Prepayment

It is possible to pay via prepayment. To do this one would transfer the stated price given in the ordering process into the specified account. The account will be specified in the confirmation of order and the product will be delivered once the payment has taken place.

PayPal

Paypal is an online payment process, that works with a bank account or creditcard link. that works via linkage with a bank account or creditcard To be able to pay via PayPal you must first have a PayPal account, which can be opened in the process of ordering. Further information on PayPal is available under www.paypal.de.

Creditcard (MasterCard, Visa)

To pay with one of the above mentioned Creditcards, it is necessary to choose the relevant card and enter the required details in the relevant fields.

9. RIGHT OF REVOCATION

Instruction of Right of Revocation

The customer has the right to return new unworn or unused goods within 14 days. The 14-day-period starts from recieval of the receipt of this instruction (via e-mail), but not before the delivery of the product to the customer. If you would like to make use of your right to return please contact us by mail (mail@johannagauder.com) so we can declare the process of the return action consignment. Orders returned without authorization will not be accepted. If a returned item is shipped internationally, please clearly mark the package ‚Returned Goods‘, to avoid any Customs charges. Products must be returned in their original packaging or in other adequate or equivalent packaging that ensures it is protected against transportation damage. The customer is responsible for all damage sustained due to inadequate packaging when returning goods.

Consequences of revocation

In case of withdrawal, we will reimburse all payments received from the customer, including the shipping costs for delivering the product to the customer with the exception of additional costs that may arise when the customer wishes a different method of shipping than the standard shipment (e.g. express shipment), within 14 days from the day on which we receive the communication of withdrawal. Online orders returned will be refunded to the original payment method used for the order. We may withhold the reimbursement until we have received or collected the product back, or until the customer has supplied evidence of having sent back the goods, whichever is the earliest. The customer must return the goods no later than 14 days after having informed us about the decision to withdraw. The customer must pay for the immediate costs of the return shipment. Shipping within Germany costs up to a maximum of 6,00€. Please note that the return shipping fee will be deducted from your refund. Compensation for lost value has to be made only if the derived use or deterioration is in conjunction with use of the product that goes beyond inspecting the product and its characteristics.

Exceptions from the right of withdrawal:

The right of cancellation does not apply to the delivery of goods that are manufactured according to customer specifications or that have been clearly tailored to personal requirements. End of Instruction of Right of Revocation

10. GUARANTEE

Relevant legal provisions apply in case of defective goods.

11. APPLICABLE LAW

Agreements are governed by the law of the Federal Republic of Germany in exclusion of the UN buying law, as far as no binding international consumer protection law is in opposition.

12. CONTRACT LANGUAGE

Contract language is German.

13. FINAL PROVISIONS

If single conditions be or become invalid, this will not effect other conditions. Should single stipulations be or become invalid, so will none of the other stipulations become invalid.
